3.5.ApplicationofAdditionalTerms
Youmaychoosetooffer,andtochargeafeefor,warranty,support,indemnityorliability
obligationstooneormorerecipientsofCoveredSoftware.However,Youmaydosoonly
onYourownbehalf,andnotonbehalfofanyContributor.Youmustmakeitabsolutely
clearthatanysuchwarranty,support,indemnity,orliabilityobligationisofferedbyYou
alone,andYouherebyagreetoindemnifyeveryContributorforanyliabilityincurredby
suchContributorasaresultofwarranty,support,indemnityorliabilitytermsYouoffer.You
mayincludeadditionaldisclaimersofwarrantyandlimitationsofliabilityspecifictoany
jurisdiction.
4.InabilitytoComplyDuetoStatuteorRegulation
IfitisimpossibleforYoutocomplywithanyofthetermsofthisLicensewithrespectto
someoralloftheCoveredSoftwareduetostatute,judicialorder,orregulationthenYou
must:(a)complywiththetermsofthisLicensetothemaximumextentpossible;and(b)
describethelimitationsandthecodetheyaffect.Suchdescriptionmustbeplacedinatext
fileincludedwithalldistributionsoftheCoveredSoftwareunderthisLicense.Excepttothe
extentprohibitedbystatuteorregulation,suchdescriptionmustbesufficientlydetailed
forarecipientofordinaryskilltobeabletounderstandit.
5.Termination
5.1.TherightsgrantedunderthisLicensewillterminateautomaticallyifYoufailtocomply
withanyofitsterms.However,ifYoubecomecompliant,thentherightsgrantedunderthis
LicensefromaparticularContributorarereinstated(a)provisionally,unlessanduntilsuch
ContributorexplicitlyandfinallyterminatesYourgrants,and(b)onanongoingbasis,if
suchContributorfailstonotifyYouofthenon-compliancebysomereasonablemeansprior
to60daysafterYouhavecomebackintocompliance.Moreover,Yourgrantsfroma
particularContributorarereinstatedonanongoingbasisifsuchContributornotifiesYouof
thenon-compliancebysomereasonablemeans,thisisthefirsttimeYouhavereceived
noticeofnon-compliancewiththisLicensefromsuchContributor,andYoubecome
compliantpriorto30daysafterYourreceiptofthenotice.
5.2.IfYouinitiatelitigationagainstanyentitybyassertingapatentinfringementclaim
(excludingdeclaratoryjudgmentactions,counter-claims,andcross-claims)allegingthata
ContributorVersiondirectlyorindirectlyinfringesanypatent,thentherightsgrantedto
YoubyanyandallContributorsfortheCoveredSoftwareunderSection2.1ofthisLicense
shallterminate.
5.3.IntheeventofterminationunderSections5.1or5.2above,allenduserlicense
agreements(excludingdistributorsandresellers)whichhavebeenvalidlygrantedbyYou
orYourdistributorsunderthisLicensepriortoterminationshallsurvivetermination.
